At émigré, we believe trust is important. Whether you place an order, contact us for fragrance advice, use our website or visit our shop: we handle your personal data with care and take appropriate measures to protect it.

We process personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR).

In this privacy policy, we explain what personal data we process, why we do so, the legal basis for doing so, how long we retain data, with whom we share data, and what rights you have regarding your personal data.

We process personal data exclusively for purposes related to our services, including:

Article 4

Online shop orders and payments

You may choose to create an account in the émigré online shop. An account makes it easier to place orders, view your order history, manage your saved address details and check out more quickly for future purchases.

When you create an account, we may process the following personal data, amongst other things:

  • name;
  • email address;
  • telephone number;
  • billing and delivery address(es);
  • order history;
  • preferences that you share with us.

We use this data to:

  • make your account available and manage it;
  • process orders more easily and quickly;
  • provide an overview of previous purchases;
  • handle customer service and service requests more efficiently;
  • save your preferences, insofar as you share them with us yourself.

The legal basis for this processing is the performance of the contract with you, namely the provision and management of your account.

You are not obliged to create an account to place an order. You can also check out as a guest. In that case, we will only process the data necessary to process your order.

You can view, edit or delete your account details at any time. If you request the deletion of your account, certain data may still be retained to the extent that we are legally obliged to do so or where this is necessary for the processing of outstanding orders, returns, disputes or administrative obligations.


Article 5

Account and customer data

When you place an order via the émigré webshop, we process the personal data necessary to fulfil your order, process payments and contact you regarding your purchase.

Depending on the order, we may process the following personal data, among other things:

  • name;
  • billing address and delivery address;
  • email address;
  • telephone number;
  • payment details;
  • order details and purchase history;
  • any correspondence relating to your order, return or service request.

We use this personal data to:

  • process and deliver your order;
  • securely process payments;
  • send order confirmations, dispatch information and service messages;
  • handle returns, complaints or queries regarding orders;
  • prevent and detect fraud, misuse or security incidents;
  • comply with administrative, tax and legal obligations.

Payments via our webshop are processed by selected payment providers. Depending on the chosen payment method, personal data may be processed directly by these parties. Émigré does not receive full payment card details such as credit card numbers.

For the delivery of orders, personal data may be shared with delivery services and logistics partners to the extent necessary for the performance of the contract.

The legal basis for this processing is primarily the performance of the contract with you. In addition, certain data may be processed on the basis of legal obligations or our legitimate interest, for example to prevent fraud, to secure our services and to handle enquiries or disputes carefully.

When you place an order without creating an account, we process only the data necessary to fulfil your order.


Article 6

Newsletter and marketing

When you sign up for the émigré newsletter, we use your email address to inform you about new brands, collections, products, events, workshops and other developments relating to émigré.

The legal basis for sending newsletters is your consent.

You can unsubscribe from our newsletter at any time via the unsubscribe link at the bottom of every email or by contacting us at privacy@emigre.nl. Withdrawing consent does not affect the lawfulness of previous processing based on that consent.

Depending on how our newsletter service is set up, we may process information about your interaction with newsletters, such as whether an email has been opened or a link clicked. We use this information solely to improve our communications and services.

In addition, to the extent permitted by law, we may inform existing customers about similar products, services or events from émigré. You can unsubscribe from such communications at any time.

Émigré does not currently use automated decision-making or profiling that has legal consequences or otherwise significantly affects you.


Article 7

Customer service and fragrance advice

When you contact émigré with a question, order, return, complaint, product advice or fragrance advice, we process the personal data necessary to assist you as effectively as possible.

Depending on the nature of the contact, we may process the following personal data, amongst other things:

  • name;
  • email address;
  • telephone number;
  • order details and purchase history;
  • correspondence via email, social media or other communication channels;
  • information you voluntarily share with us in the context of fragrance advice or product preferences.

We use this data to:

  • handle enquiries, requests or complaints;
  • provide support with orders, returns or service requests;
  • provide appropriate fragrance advice or product advice;
  • take previous communications or purchases into account in our advice, where relevant;
  • improve our services and customer service.

When you voluntarily share information about fragrance preferences, favourite ingredients, previous perfumes or similar preferences, we may use this information to provide better and more personalised advice.

We do not ask you to share any special or sensitive personal data with us, such as medical data, unless this is necessary in the context of a specific enquiry, for example regarding a known sensitivity or allergy. In that case, we will use this information solely to answer your enquiry carefully.

The legal basis for this processing is the performance of the contract with you, your request for advice or support, and our legitimate interest in being able to provide our services carefully and personally.

We do not retain correspondence with our customer service team for longer than is necessary to deal with your enquiry, order or service request, unless a longer retention period is necessary in connection with a dispute, a legal obligation or an ongoing customer relationship.


Article 8

Store visits and in-store services

When you visit an Émigré physical store, we generally process as little personal data as possible.

For a standard in-store purchase, it is generally not necessary to process personal data. However, in certain situations we may process personal data, for example when you receive a digital receipt, have an order dispatched, reserve a product, submit a service request or contact us regarding a purchase.

Depending on the situation, we may process the following personal data, amongst other things:

  • name;
  • email address;
  • telephone number;
  • billing or delivery address;
  • order and purchase details;
  • correspondence relating to a purchase or service request.

We use this data to:

  • process purchases, reservations or orders;
  • dispatch products;
  • provide digital receipts or order information;
  • contact you regarding an order, reservation or service request;
  • carefully handle returns, complaints or after-sales service.

When you visit émigré for fragrance advice, an appointment or a guided consultation, we may process information that you voluntarily share with us in order to serve you better. You can read more about this in Article 7 – Customer service and fragrance advice.

The legal basis for this processing is the performance of the contract with you, your request for a service or support and, where relevant, our legitimate interest in providing our services with due care.

Should security measures such as CCTV surveillance be implemented in the future to protect customers, staff, products or property, émigré will clearly inform you of this in accordance with applicable laws and regulations.


Article 9

Workshops, events and appointments

Émigré may organise workshops, events, fragrance consultations, in-store appointments or other small-scale gatherings. When you register for an event, workshop or appointment, we process the personal data necessary to facilitate your participation and to communicate with you.

Depending on the nature of the event or appointment, we may process the following personal data, amongst other things:

  • name;
  • email address;
  • telephone number;
  • date and time of the booking or participation;
  • payment details, if the event is a paid event;
  • information you voluntarily share with us in connection with your participation or preferences.

We use this data to:

  • process your booking or participation;
  • contact you regarding practical information, changes or cancellations;
  • process payments, where applicable;
  • provide an appropriate experience or guidance during workshops, consultations or appointments;
  • improve our services and future events.

Where an event or workshop requires specific practical information, such as scent preferences or known sensitivities relevant to participation, we process only the information you voluntarily provide and only to the extent necessary.

The legal basis for this processing is the performance of the contract with you, your request to participate in an event or appointment and, where relevant, your consent.

Photographs or video footage taken during an event in which visitors are recognisable will only be used where there is a valid legal basis for doing so, for example your consent.

We do not retain personal data collected in connection with workshops, events or appointments for longer than is necessary for their organisation, handling and any follow-up, unless a longer retention period is required by law or is necessary.


Article 10

Social media

Émigré may be active on social media platforms, such as Instagram, Facebook, Pinterest, TikTok, LinkedIn or other similar platforms.

When you follow Émigré, send a message, comment on a post, share content in which Émigré is mentioned, or communicate with us in any other way via social media, we may process personal data that you make available via the relevant platform.

Depending on the situation, this may include:

  • name or profile name;
  • public profile information;
  • content of posts, comments or interactions;
  • correspondence via social media;
  • information you voluntarily share with us.

We use this data to:

  • respond to questions, requests or comments;
  • provide customer service or fragrance advice;
  • share information about products, brands, events and developments relating to émigré;
  • gain insight into how our social media is used;
  • improve our communication and services.

When you contact us via social media, we may retain relevant correspondence to the extent necessary to handle your question or request.

Émigré may use social media platforms to promote information, campaigns or advertisements. Insofar as personal data is processed in this context via cookies, tracking technologies or advertising platforms, this is done in accordance with Article 3 – Website visits, cookies and technologies and our Cookie Policy.

Social media platforms also process personal data for their own purposes. The privacy terms and conditions of the relevant platform therefore also apply to the use of these platforms. Émigré has no control over the way in which these third parties process personal data.


Article 11

With whom does Émigré share personal data?

Émigré shares personal data only where this is necessary for the provision of our services, where we are legally obliged to do so, or where you have given your consent.

Depending on the situation, we may share personal data with carefully selected third parties who support us in providing our services, including:

  • online shop and hosting services;
  • payment providers;
  • delivery and logistics partners;
  • providers of email and newsletter services;
  • IT, security and communication platforms;
  • accounting, administrative or professional advisers;
  • parties providing support for customer service, website management or technical services.

We share personal data only to the extent necessary for the relevant purpose. For example, name, address and contact details may be shared with delivery services to enable an order to be delivered, or with payment providers to process payments securely.

When third parties process personal data on behalf of émigré, they act as processors. In such cases, we ensure that appropriate agreements are made regarding the protection and confidentiality of personal data, to the extent required by law.

Some parties with whom we collaborate, such as payment providers, delivery services or social media platforms, may also process personal data as independent data controllers. In such cases, the processing of personal data by that party is also subject to their own privacy policy.

Émigré does not sell personal data to third parties.

In addition, personal data may be shared where necessary to comply with a legal obligation, a court order, a request from competent authorities, or to protect the rights, property or safety of Émigré, customers or third parties.


Article 12

Transfer outside the European Economic Area (EEA)

Émigré uses service providers who support us in offering our website, online shop, payments, communications and other services. In some cases, these parties may process personal data outside the European Economic Area (EEA).

This may be the case, for example, where a service provider uses servers, systems or support services located outside the EEA, including in countries where the level of protection for personal data may differ from that within the European Union.

Where personal data is processed outside the EEA, émigré ensures that this is done in accordance with applicable data protection legislation and the requirements of the General Data Protection Regulation (GDPR).

Where necessary, we take appropriate measures to protect personal data, for example by using:

  • an adequacy decision by the European Commission;
  • Standard Contractual Clauses approved by the European Commission;
  • additional security measures where necessary.

We carefully assess the parties with whom we collaborate and expect our service providers to take appropriate technical and organisational measures to adequately protect personal data.

Article 13

How do we protect personal data?

Émigré takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access, misuse, alteration, disclosure or other forms of unlawful processing.

We aim to process personal data only to the extent necessary and restrict access to personal data to individuals or service providers who require this information to carry out their duties.

To protect personal data as effectively as possible, Émigré utilises appropriate security measures, including where relevant:

  • secure connections (such as SSL/TLS encryption);
  • secure systems and access restrictions;
  • carefully selected service providers and software platforms;
  • appropriate security settings for webshop, payment and communication environments;
  • periodic evaluation of security measures, insofar as appropriate to the nature and scope of our services.

Payments via the online shop are processed through selected payment providers. Émigré does not receive or store full payment card details, such as full credit card numbers.

Although we take appropriate measures to protect personal data, no method of data transmission or electronic storage can guarantee complete security. Should a security incident or data breach occur despite our measures, we will act in accordance with applicable laws and regulations.

Article 14

How long do we retain personal data?

Émigré does not retain personal data for longer than is necessary for the purposes for which it was collected or processed, unless a longer retention period is required by law or is necessary for the establishment, exercise or defence of legal claims.

Depending on the type of data and the purpose of the processing, Émigré generally applies the following retention periods:

Orders and invoice details

We retain data relating to orders, payments and invoices for as long as is necessary for the performance of the contract and to the extent required under applicable administrative and tax legislation.

Account data

We retain data linked to a webshop account for as long as the account is active. If the account is not used for an extended period, Émigré may decide to clean up or delete inactive accounts.

You may request the deletion of your account at any time. However, certain data may be retained where necessary for outstanding orders, returns, disputes or legal obligations.

Newsletter and marketing

If you have subscribed to our newsletter, we will retain your data until you unsubscribe, withdraw your consent or we determine that communication is no longer relevant.

Customer service and fragrance advice

We generally do not retain correspondence relating to customer service, fragrance advice, service requests, queries or complaints for longer than is necessary to deal with them and, as a rule, for a maximum of two (2) years after the last point of contact, unless a longer retention period is necessary in connection with a dispute, legal obligation or ongoing customer relationship.

Workshops, events and appointments

In principle, we do not retain personal data processed in connection with workshops, events, consultations or appointments for longer than is necessary for their organisation and handling, and as a rule for a maximum of twelve (12) months after they have ended.

Website and cookie data

Data collected via cookies, analytical tools or similar technologies is retained in accordance with the retention periods of the relevant systems or as set out in our Cookie Policy.

Fraud, misuse and disputes

Where necessary for the prevention, investigation or resolution of fraud, misuse, security incidents or legal disputes, relevant personal data may be retained for longer, insofar as this is necessary and proportionate.

Once the applicable retention period has expired, personal data will be deleted, anonymised or otherwise processed in such a way that it can no longer be traced back to an individual, unless we are legally obliged to retain data for longer.

Your rights under the GDPR

Under the General Data Protection Regulation (GDPR), you have various rights regarding your personal data.

Request access

You may request access to the personal data that émigré processes about you and receive information on how and why this data is used.

Rectify data

If personal data is inaccurate or incomplete, you may request that it be rectified or supplemented.

Have data erased

You may request that personal data be erased. However, in certain cases we may continue to retain data, for example where this is necessary for legal obligations, administrative purposes or ongoing disputes.

Restriction of processing

You may request that the processing of personal data be temporarily restricted, for example where you dispute the accuracy of personal data or have objected to processing.

Objection

You have the right to object to certain processing of personal data, including processing based on a legitimate interest or direct marketing.

Data portability

Where processing is based on your consent or the performance of a contract and is carried out by automated means, you have the right to receive the personal data you have provided to émigré in a structured, commonly used and machine-readable format, or to have it transferred to another party, insofar as this is technically feasible.

Withdrawing consent

Where processing is based on your consent, you may withdraw this consent at any time. Withdrawing consent does not affect the lawfulness of processing carried out prior to the withdrawal.

Third-party websites

The Émigré website may contain links to third-party websites, platforms or services, such as brands, suppliers, social media platforms, payment providers or delivery services.

When you leave our website via a link and visit a third-party website, the privacy policy of that party applies. Émigré has no control over the content, operation or manner in which these third parties process personal data.

We recommend that you consult the privacy policy of the relevant website or service provider before providing personal data or using their services.

This privacy policy applies exclusively to personal data processed by Émigré.
