Right of Withdrawal

As a consumer within the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason, subject to the exceptions described below.

Article 1

Withdrawal period

As a consumer, you have the right to withdraw from your purchase within fourteen (14) days of receiving your order without giving any reason.

The withdrawal period expires fourteen (14) days after the day on which you, or a third party designated by you who is not the carrier, took physical possession of the product.

To exercise your right of withdrawal, you must inform us unequivocally of your decision to withdraw from the contract within this period. You can do this by submitting a withdrawal or return request via your customer account at account.emigre.nl or by sending an email to returns@emigre.nl. You are not obliged to use the model withdrawal form at the bottom of this page.

Article 2

How to withdraw

1. To exercise your right of withdrawal, you must inform us unequivocally of your decision to withdraw from the contract within the withdrawal period.
2. You can do this by submitting a cancellation or returns request via your customer account at account.emigre.nl or by sending an email to returns@emigre.nl.
3. Upon receipt of your request, we will, where applicable, provide further instructions for the return shipment.
4. If you wish, you may use the model withdrawal form at the bottom of this page, but this is not mandatory.

Article 3

Returns

1. Once you have exercised your right of withdrawal, you must return the product to us or hand it over to us without delay, but no later than fourteen (14) days from the day on which you informed us of your decision to withdraw.
2. You are on time if you return the goods before the period of fourteen (14) days has expired.
3. The direct costs of returning the goods are borne by the consumer, unless expressly agreed otherwise.
4. We ask you to return products, where reasonably possible, in their original packaging and carefully packed to prevent damage during transport.

Article 4

Refund

If you withdraw from the contract, you will receive a refund of all payments received from you in respect of the returned products, including standard delivery costs (if applicable), without delay and in any event no later than fourteen (14) days after we have been informed of your decision to withdraw from the contract.

We may withhold the refund until we have received the goods back, or until you have provided evidence that you have returned the goods, whichever is earlier.

Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise. No fees will be charged for such a refund.

Any additional costs arising from a delivery method chosen by you other than the cheapest standard delivery offered by us will not be refunded.

Article 5

Exceptions to the right of withdrawal

The right of withdrawal applies only insofar as the products are in a condition that is reasonably necessary to ascertain their nature, characteristics and functioning, as one might do in a physical shop.

Certain products may be excluded from the right of withdrawal pursuant to Article 6:230p of the Civil Code. This applies, amongst other things, to sealed products which, for reasons of health protection or hygiene, are not suitable for return and whose seal has been broken after delivery.

For perfumes and other cosmetic products, items that have been used beyond what is reasonably necessary to assess their nature, characteristics and functioning are, in principle, not eligible for return, unless there is a manufacturing defect, transport damage or an incorrect delivery by émigré.

If a product shows signs of use that go beyond what is necessary for assessment, we reserve the right to charge for a reduction in value in accordance with applicable consumer legislation.
